EMERGENCY EVENT AND PROFESSIONAL MONITORING TERMS OF SERVICE

1. ENTIRE AGREEMENT


These Emergency Event and Professional Monitoring Terms of Service (“Emergency Event Terms”) govern your use of Ring’s Emergency Event Solutions (defined below) and are incorporated into and form a part of the Agreement (as defined in the Ring Terms of Service) between Ring and you. “Emergency Event Solutions” mean, collectively, any Ring Offerings used to provide emergency event notifications or services (e.g., Ring Alarm, Ring Alarm Flood & Freeze Sensor, Ring Smoke & CO Listener), including Professional Protection Services. “Professional Protection Services” (including Ring Professional Monitoring, 24/7 Smoke & Co Professional Monitoring, and Virtual Security Guard) are additionally activated professional monitoring services that have the ability to request dispatch from emergency responders under certain circumstances. Capitalized terms used but not defined in these Emergency Event Terms have the meanings given to them in the Ring Terms of Service. In the event of any conflict between these Emergency Event Terms and the Ring Terms of Service, these Emergency Event Terms will control with respect to the Emergency Event Solutions to the extent of the conflict.

2. GENERAL


Emergency Event Solutions are intended to assist with the detection and notification of emergency events (such as unauthorized intrusions, fire, smoke, carbon monoxide, or water damage) (“Emergency Events”), as opposed to preventing or eliminating occurrences of Emergency Events. Emergency Event Solutions are not: (1) guaranteed to detect all Emergency Events; or (2) responsible for preventing harm such as death or injury. In all cases, directly contact emergency responders (e.g., 911) immediately if you encounter any Emergency Event.

If you have activated Professional Protection Services, we may request dispatch of emergency responders in response to Emergency Events under some circumstances, but our request is not guaranteed to result in the dispatch of emergency services, and Ring does not have the ability to directly dispatch emergency services to your home. Any customer service and any customer support offered or provided by Ring does not constitute: (a) a 911 or any other emergency alert or support service provided by governmental authorities, including law enforcement; (b) a dispatch center or dispatch service; or (c) an emergency service provider.

If Ring requests dispatch of emergency services, then the applicable law, policies of local law enforcement agencies and other governmental bodies, and availability of local resources may impact the emergency response or Professional Protection Services you receive. For example, certain law enforcement agencies may require audio, video, or human verification of a crime in progress before dispatching an officer, and law enforcement agency response times may vary by jurisdiction based on local policies, priorities, and available resources. You release Ring from all liability for any loss arising from delay, refusal, or failure of emergency responders to dispatch to your Registered Address.

IMPORTANT: YOUR PROFESSIONAL PROTECTION SERVICE WILL NOT REQUEST DISPATCH FROM EMERGENCY RESPONDERS IF:
(1) YOU HAVE NOT COMPLETED SETUP FOR OR ACTIVATED YOUR PROFESSIONAL PROTECTION SERVICE;
(2) WE ARE UNABLE TO VERIFY YOUR REGISTERED ADDRESS; AND/OR
(3) YOU ARE WITHIN YOUR TEST PERIOD (DEFINED BELOW).

3. REGISTERED ADDRESS AND CONTACT INFORMATION


In order to activate certain Emergency Event Solutions, you must complete all setup steps in your Ring account and you must accurately provide all information required by Ring, such as the address at which you are using the service (“Registered Address”), your contact information, and your emergency contacts. You agree to keep your Registered Address, contact information, emergency contacts and all other required information up-to-date at all times.
If you identify any emergency contacts in your account, you agree that your emergency contacts are authorized to act on your behalf, including verifying or canceling Emergency Event alerts, and that Ring may contact your emergency contacts about your Professional Protection Service.

4. TEST PERIOD


After you set up Ring Professional Monitoring, or any other Professional Protection Service that includes Ring Professional Monitoring, Ring will place your Professional Protection Service into a seven (7) day practice mode, or any interval for testing otherwise required by applicable law (the “Test Period”). The Professional Protection Service can be activated only after the completion of the Test Period. During the Test Period, Ring will not respond to signals from your monitored device or request dispatch of emergency responders.

5. PERMIT AND REGISTRATION REQUIREMENTS


Some local governments have permit or registration requirements related to alarm monitoring and requests for emergency dispatch. If you are required to obtain a permit or registration, you are solely responsible for: (1) meeting all local government requirements for Ring Professional Monitoring permits and registrations (including completing any required applications, paying any required fees, and maintaining any required permits); and (2) keeping your account updated with current and accurate permit or registration information.

Ring will only obtain a permit or registration on your behalf if we are specifically required to do so by applicable law. In that instance, you will receive an email after completing enrollment in Ring Professional Monitoring.

You are responsible for any permit or registration fees required by local government for your Ring Professional Monitoring and for you any fines and penalties assessed due to permit or registration requirement non-compliance (including any fines or penalties against you or Ring). If any local government requires Ring to obtain, maintain, or renew a permit or registration for your Ring Professional Monitoring, then you authorize Ring to charge the payment method associated with your account. Ring will notify you of any such charges to your payment method.

6. FALSE ALARMS


For Professional Protection Services, you agree that Ring may take reasonable steps before requesting dispatch from emergency responders. They may first try to contact you or your emergency contacts to verify an Emergency Event alert. They may also attempt to verify the Emergency Event by communicating with someone at your Registered Address or using other methods before notifying you or your emergency contacts. If they believe there is no verified Emergency Event, they can decide not to request dispatch from emergency responders at their discretion. If any false alarms or failure to comply with applicable laws, or your response to information and events while using the Professional Protection Services results in fines or other amounts being assessed by local government or any other third party - whether against you or Ring - you will be responsible for paying these fines and assessments. You authorize Ring to charge any such fines or other amounts to your account’s payment method.

7. USE OF COMMUNICATIONS


Please see Ring’s Privacy Notice for information regarding the collection and use of personal information collected through your Emergency Event Solutions (e.g., videos, images, and audio), or to which Ring has access as a result of you, your emergency contact, or any other person contacting Ring (e.g., by telephone to report an emergency or other event). You agree that Ring may contact you for any Notification Purpose, and that contact may be made using any method, including telephone calls, automatic telephone dialing systems, or text or email messages sent to your enabled wireless device. Communications between you (or your emergency contacts) and Ring may be recorded.

8. PROFESSIONAL MONITORING SUITABILITY


Ring reserves the right, in its sole discretion, to terminate or decline to provide Professional Protection Services if we determine that your property's characteristics, location, environmental conditions, or some other factor make it unsuitable for effective camera or other monitoring.

9. ELIGIBLE LOCATIONS FOR EMERGENCY EVENT SOLUTIONS


If your Registered Address is residential, you may only use the Emergency Event Solutions at the following location types: a single-family residence or a single unit within a multi-family residence (such as an individual apartment). If your Registered Address is the entirety of a multi-family residence (such as an apartment building), a commercial location, or a job site, you may not use the Emergency Event Solutions as a fire, smoke, or carbon monoxide detection system. Unless otherwise explicitly disclosed in the technical specifications for the relevant Ring Offering, Emergency Event Solutions should not be used to satisfy requirements regarding fire alarm or other safety code regulations (including smoke or carbon monoxide regulations).

10. RING ALARM GUARD RESPONSE


Certain subscribers of Professional Protection Services may have the option of selecting Ring Alarm Guard Response for an additional fee. If you choose Ring Alarm Guard Response and a private guard responder is dispatched to your Registered Address, you hereby authorize the private guard responder to access the exterior areas of the Registered Address (including, but not limited to, doors, windows, gates and all entry points) in an effort to verify the alarm. Further, the private guard responder’s sole responsibility is to provide alarm verification. The private guard responder is not an emergency responder and has no duty to provide any emergency or other assistance or aid (medical or otherwise), guard or personal protection services for you or others, otherwise confront or apprehend any intruder, or otherwise intervene in any manner.

11. RISK OF LOSS AND INSURANCE COVERAGE; LIMITATION OF LIABILITY


You should protect against any risk of loss with the appropriate insurance coverage, and you are responsible for obtaining all insurance coverage you believe is necessary. Without limiting the terms in the Ring Terms of Service, and to the fullest extent permitted by applicable law and the applicable policy or policies of insurance you obtain and maintain, you release Ring, from all liability for any loss, occurrence, event, or condition covered by your insurance.
Any dispute or claim arising from or relating to this Emergency Event Terms of Service or the Emergency Event Solutions is subject to the dispute resolution, governing law, disclaimer of warranties, limitation of liability, and all other terms in the Ring Terms of Service.

12. STATE LICENSURE AND ADDRESS FOR RING
